Price List of Brokerage Services

This Price List is adopted in accordance with the Real Estate Brokerage Act and forms an integral part of the General Terms and Conditions of Business and of every brokerage agreement the Broker concludes with a principal or a third party. The amount of the brokerage fee is determined by the brokerage agreement, in accordance with this Price List, the General Terms and Conditions of Business and the Act. The amounts stated in this Price List represent the maximum brokerage fees.

1. Brokerage Fees

Brokerage in the Sale of a Property

If the seller is the Broker’s principal, the brokerage fee amounts to 3 % to 6 % of the achieved purchase price, and no less than EUR 1,200.00.

Brokerage in the Purchase of a Property

If the buyer is the Broker’s principal, the brokerage fee amounts to 3 % to 6 % of the achieved purchase price, and no less than EUR 1,200.00.

In brokerage for the exchange of properties, the fee is charged to each party to the exchange, and the percentage is calculated on the value of the property acquired by that party through the exchange.

Brokerage in Letting a Property for Lease or Rent

If the landlord or lessor is the Broker’s principal:

  • for agreements shorter than 6 months – 75 % of one month’s rent;
  • for agreements from 6 to 36 months – 100 % of one month’s rent;
  • for agreements of 36 months and longer – 150 % of one month’s rent.

Brokerage in Taking a Property on Lease or Rent

If the tenant or lessee is the Broker’s principal:

  • for agreements shorter than 6 months – 75 % of one month’s rent;
  • for agreements from 6 to 36 months – 100 % of one month’s rent;
  • for agreements of 36 months and longer – 150 % of one month’s rent.

2. Services Covered by the Brokerage Fee

The brokerage fee covers the regular brokerage services the Broker provides during the preparation and completion of the legal transaction, in particular:

  • finding and connecting the principal with a potential contracting party for the purpose of concluding the legal transaction;
  • assessing the property’s market position and informing the principal of market conditions and comparable prices, as well as of the average market price of a comparable property;
  • verifying the condition of the property and collecting and inspecting the documents evidencing ownership or another real right over the property, to the extent of the available data;
  • preparatory work for the conclusion of the legal transaction;
  • verifying the designated use of land in accordance with spatial planning regulations, where the subject of brokerage is land;
  • preparing presentation materials and professionally preparing the property for the market with a detailed description using photographs, floor plans and VR, and scheduling viewings in person or via VR technology;
  • advertising the property through appropriate marketing channels domestically and abroad, where applicable;
  • organising and conducting property viewings;
  • communicating with interested buyers, tenants or other potential contracting parties;
  • participating in negotiations in order to achieve terms acceptable to the principal;
  • informing the principal in good time of all circumstances relevant to the conclusion of the legal transaction that are known to the Broker or ought to be known;
  • cooperating with legal service providers who supervise and manage the entire sale process, from the preparation of the preliminary agreement, the purchase agreement and the tabular declaration through to the registration of ownership rights in the land registry, as well as lease/rental agreements;
  • preparing a detailed handover report with the contracting parties;
  • assisting with the transfer of utility costs to the new owner or the new tenant/lessee;
  • informing the principal of the obligations arising from regulations on the prevention of money laundering and terrorist financing;
  • maintaining the confidentiality of information and protecting the principal’s personal data in accordance with applicable regulations;
  • acting with the care of a good expert in accordance with the rules of the profession.

3. Brokerage for Both Parties

In connection with brokerage for the same property, the Broker may charge a brokerage fee to the principal and to the third party who becomes a principal, provided that the Broker has concluded a separate brokerage agreement with each party. A brokerage fee may be charged exclusively to a person with whom a brokerage agreement has been concluded.

Sale and Exchange

The maximum total amount of brokerage fees the Broker may charge to all principals for the same property is 12 % (twelve per cent) of the agreed purchase price or the value of the legal transaction. If it has been agreed that both contracting parties pay the fee, their total amount may not exceed the stated limit.

If the Broker has concluded brokerage agreements with two principals for the same property but it has been agreed that only one contracting party pays the brokerage fee, the Broker may charge that party no more than half of the maximum total amount set out in this Price List, that is, no more than 6 % (six per cent) of the agreed purchase price or the value of the legal transaction.

Lease and Rent

The maximum total amount of brokerage fees the Broker may charge to all principals for the same property is 300 % (three hundred per cent) of one month’s rent. If it has been agreed that both contracting parties pay the fee, their total amount may not exceed the stated limit.

If the Broker has concluded brokerage agreements with two principals for the same property but it has been agreed that only one contracting party pays the brokerage fee, the Broker may charge that party no more than half of the maximum total amount set out in this Price List, that is, no more than 150 % (one hundred and fifty per cent) of one month’s rent.

4. Charging a Fee to a Third Party

The Broker does not charge a brokerage fee to a third party who acquires the role of buyer, tenant, lessee or another role in the legal transaction and who has not concluded a brokerage agreement with the Broker. A viewing of the property is not made conditional upon the signing of a brokerage agreement. Signing a property viewing confirmation is not deemed to be a brokerage agreement and does not create an obligation to pay a brokerage fee.

5. Additional Services and Costs

The brokerage fee relates to the regular brokerage services set out in point 2 of this Price List. All additional services not covered by the Broker’s regular activities are agreed separately. At the principal’s request, the Broker may organise and/or coordinate:

  • property valuations;
  • land surveying services;
  • the preparation of energy certificates;
  • financial and tax advisory services;
  • assistance in obtaining financing.

The costs of lawyers, notaries public, court fees, taxes, land surveying services, valuers, banks, translators and other professionals are not included in the brokerage fee, unless otherwise agreed. Additional services are charged in the amount of the actual costs, subject to prior notice to and the consent of the principal, and with the party liable for payment indicated in the brokerage agreement.

6. Value Added Tax

The Broker is not registered for VAT, and therefore VAT is not charged on the brokerage fee or on the fees set out in this Price List, pursuant to Article 90, paragraph 2 of the Value Added Tax Act.

7. Final Provisions

This Price List is displayed in a visible and accessible place on the Broker’s business premises and published at https://luvano.homes/hr/cjenik. The Broker reserves the right to amend and/or supplement this Price List, whereby the relationship between the Broker and the principal is subject to the Price List in force at the time of the conclusion of the brokerage agreement. The valid Price List, bearing the stated date and year, is annexed to every brokerage agreement and is signed by the Broker and the principal or the third party.
